Terms of use

These Terms of Use ("Terms") govern your use of the AMBO mobile application (the "App"), provided by Mathe Wieme, an individual based in the United Arab Emirates ("AMBO", "we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 16 years old to use the App. By using it, you confirm that you meet this requirement and that you can form a binding agreement with us.

2. The service

AMBO lets you record your boxing sessions, analyses your movement, and provides feedback, guided sessions and training drills. We may update, change or discontinue features at any time.

3. Subscriptions and free trials

Guided sessions and drill paths are part of AMBO Premium, an auto-renewing subscription sold through the Apple App Store, monthly or yearly. The price and the length of any free trial are shown in the App before you subscribe.

• Payment is charged to your Apple ID account when you confirm the purchase or, if you start with a free trial, when the trial ends.
• Your subscription renews automatically at the end of each period unless you turn off auto-renew at least 24 hours before the period ends. Your Apple ID account is charged for the renewal within the 24 hours before the period ends, at the price then in effect.
• If you don't cancel at least 24 hours before your free trial ends, the subscription starts and you are charged. Any unused part of a free trial ends when you buy a subscription.
• You can manage or cancel your subscription in your Apple ID settings (on iPhone: Settings, your name, Subscriptions). Deleting the App or your AMBO account does not cancel it.
• Payments, renewals and refunds are handled by Apple under its own terms. You can ask Apple for a refund at reportaproblem.apple.com.
• If we change the price of a subscription, you will be told in advance as the App Store requires, and the new price applies from your next renewal.

4. Your account and licence to use the App

You sign in with Apple or Google. You can delete your account at any time in the App (Settings, Delete account) or by emailing us. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for your own, non-commercial training. You are responsible for activity that takes place through your device.

5. Your recordings and how we may use them

You keep ownership of the recordings you make with the App. By using the App, you grant us a worldwide, royalty-free licence to host, store, reproduce and process your recordings and the movement data derived from them in order to operate the App and to develop, evaluate, train and improve our products and our machine-learning models, as described in our Privacy Policy.

6. Acceptable use

• Use the App lawfully and only as intended.
• Do not record other people without their permission.
• Do not attempt to disrupt, reverse-engineer or misuse the App or our systems.
• Do not use the App to upload unlawful, harmful or infringing content.

The App's analysis and feedback are generated automatically and may be inaccurate or incomplete. They are provided for general informational purposes only and are not professional coaching or medical advice.

9. Intellectual property

The App, including its software, models, design and content (other than your own recordings), is owned by us and protected by intellectual property laws. These Terms do not transfer any of our rights to you.

10. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free or accurate.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages, or for any loss arising from your use of, or inability to use, the App, including any injury sustained while training.

12. Termination

You may stop using the App at any time. We may suspend or end your access if you breach these Terms or misuse the App.

13. Apple App Store

If you got the App from the Apple App Store, these points also apply:

• These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
• Your licence covers Apple-branded devices that you own or control, as the App Store's Usage Rules allow.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to meet any warranty that applies to it, you can tell Apple, and Apple will refund the price you paid for the App (if any). To the extent the law allows, Apple has no other warranty obligation for the App.
• We, not Apple, are responsible for any claims about the App, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection claims.
• If someone claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must follow any third-party terms that apply when you use the App, such as your mobile carrier's.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and can enforce them against you.

14. Governing law

These Terms are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, and you agree to the exclusive jurisdiction of the courts of Dubai.

15. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will ask you to review and accept the updated Terms in the App.
